Instructions

1.  Fill out order form
2.  We’ll send confirmation once order form is received with your US shipping address.
3.  Shop and confidently use our US shipping address as you shop online.
4.  We notify you once we receive your package within 2 – 3 business days.
5.  We send you an invoice with payment instructions for you to pay accordingly.
6.  We ship your package to your address in the Philippines.

Terms and Conditions

An email shall be sent to the client within 2-3 days upon receipt of the goods. All fees and charges shall be paid within fifteen (15) days upon receipt of the confirmation from KC Ships, except for perishable goods, the costs for which shall be paid within twenty-four (24) hours.   An additional storage fee in the amount of $30 shall be collected in case of payments made beyond the reglementary periods, provided KC Ships holds itself free from any liability for the condition of perishable goods that are not immediately shipped due to late payment; provided further, KC Ships shall store non-perishable goods up to thirty (30) days only and shall thereafter be free to dispose of the same as it deems fit and necessary.

The rates provided are subject to change without prior notice and it is the client’s responsibility to check with KC Ships for current rates.  The rates applied are based on the effectivity date as published.

KC Ships does not authorize the use of its address and contact information other than the intended purpose as specified herein. Accordingly, KC Ships shall not be liable for any unauthorized transaction made outside this business without its prior knowledge and consent, and reserves its right to pursue its claims and legal remedies provided under existing laws and agreements

PAYMENT

As soon as the goods/parcels are received, an invoice shall be sent to the client with payment instructions. Payments shall be made through major credit cards only processed and verified by Square.  Credit cards bearing a different name and billing address from the client’s declared name and shipping address shall not be accepted.

DELIVERY

Delivery shall be made only from US to Philippine addresses.  Delivery shall take 15 days by air and 45 to 60 days by sea, counted from date of shipment by LBC, which is the preferred courier or cargo company of KC Ships.  Shipment is made every Tuesdays only whether by sea or air. The cut-off date for receipt of goods/parcels for shipment and payment of the prescribed fees is every Saturday. 

It shall be the responsibility of the client to provide the correct address to the merchants upon purchase of the goods/parcels, as follows:

KC Ships shall not be responsible for any delay or non-delivery of goods due to wrong or incorrect address.

CLIENT WARRANTY

The client warrants that he/she is the sender, shipper, owner, or the duly authorized representative of the sender, shipper, owner of the goods/parcels and that the goods/parcels received by KC Ships are as described and declared by the client.

The client further warrants that all goods/parcels sent to KC Ships for shipment do not contain any items in commercial quantities for resale, drugs, contrabands, weapons, explosives or any illegal or counterfeit materials, pornography, or articles prohibited and/or restricted by law and are compliant with all applicable US federal and state laws as well as the laws of the country of final destination and hold KC Ships free from any liability for any illegal or prohibited items that may be found in therein.  All costs for litigation, penalties and fines that may accrue from violation of this provision shall be borne by the client.

INSPECTION OF GOODS

KC Ships reserves the right to open and inspect all packages to ensure compliance to rules and standards.  In which case, all expenses that may be incurred for the return, delay, or non-delivery of the goods/parcels due to violation of client’s warranty and/or as specified under the provision on Refusal to Deliver shall be borne by the client.

REFUSAL TO DELIVER

KC Ships may, in its own discretion, refuse to deliver any of the goods received not limited to any of the following circumstances:
Items in commercial quantities for resale, drugs, contrabands, weapons, explosives or any illegal materials or articles prohibited and/or restricted by law
Non-payment by the client
Unnamed or unknown client
Client’s violation of any of the terms and conditions

PACKAGE FORWARDING SERVICE WARRANTY

KC Ships is not a merchant or is connected in any way with the merchants.   It is a package forwarding service provider with LBC as the preferred partner courier or cargo company.  As such, it is bound by the terms and conditions of LBC.

KC Ships does not warrant that the goods/parcels are in good condition upon receipt from the client but holds itself liable to maintain the condition of the goods as is, where is and shall exercise due diligence in its handling up to shipment.  KC Ships shall be free from liability once the goods/parcels are forwarded to LBC.

FORTUITOUS EVENTS AND FORCE MAJEURE

In case of fortuitous events and/or force majeure that may cause damage, delay or prevent KC Ships to deliver the goods/parcels, the client shall be notified within twenty-four (24) hours from the cessation of the event.  The client shall have the option to cancel or proceed with the delivery.  In case of cancellation, the client shall be refunded only with the amount corresponding to the actual shipping cost.  In case of continuation of delivery, the same shall be made within twenty-four (24) hours from receipt of notice from the client.  KC Ships shall not be liable for any damage to the goods/parcels caused by a fortuitous event and/or force majeure provided it has complied with the 24-hour notice as specified herein.

INSURANCE

For insurance, please refer to LBC’s terms and conditions quoted below:

“The maximum declared value for both sea and air cargo is $500.00.  It is up to the sender to provide the declared value.  The declared value represents LBC’s maximum liability in connection with a shipment including, but not limited to, any loss, damage, delay, mis-delivery, or non-delivery.

It is the shipper’s responsibility to prove actual damages.  Exposure to and risk of any loss in excess of the declared value is assumed by the shipper.

LBC provides insurance coverage for its cargo services.  Insurance coverage must match the declared value of the shipment.

Sea Cargo – Maximum insurance coverage of $500 per shipment is available.  LBC provides automatic insurance coverage of $100 per shipment at no additional charge.  Additional coverage may be purchased at $5.00 per $100.

Air Cargo – Maximum insurance coverage of $500 per shipment is available.  LBC provides automatic insurance coverage of $50 per shipment at no additional charge.  Additional coverage may be purchased at $5.00 per $100.”

CONFIDENTIALITY

All information supplied by the client shall be held strictly confidential except when required by court orders and processes in case of violation of federal or State laws.

LAWS AND REGULATIONS

The shipping agreement as well as the terms and conditions herein set forth shall be further subject to US laws, international transportation rules, import and export laws, as well as the laws of the final destination.

CUSTOMER SERVICE

KC Ships shall respond to emails and inquiries within twenty-four (24) hours.

COPYRIGHT

The content of the KC Ships website is owned by KC Ships, and is protected by international copyright laws.  The unauthorized reproduction or use of the said website or any portion thereof shall be accordingly dealt with by law.

Placing goods/parcels with KC Ships and payment of the prescribed fees by the client shall be deemed acceptance of these terms and conditions, and shall not be refundable except for instances specified herein.

For prohibited items, please refer to LBC’s Prohibited Items quoted below:

“LBC does not accept the following prohibited items.
* Cash, currency, negotiable instruments
* Bearer Bonds
* Bills of Exchange
* Money (paper and coins)
* Negotiable instruments (stocks, bonds, cash letters and other negotiable instruments equivalent to cash)
* Commercial Quantities – items numbering more than twelve(12) piece count
* Alcoholic beverages
* Tobacco
* Pornography or any pornographic materials
* Firearms, ammunition, and war materials
* Switchblade and flick knives
* Dangerous and hazardous goods – Dangerous goods are articles or substances which are capable of posing a significant risk to health, safety or to property such as but not limited to:

    * Explosives
    * Gas
    * Flammable Liquids
    * Flammable Solids
    * Oxidizing Substances and Organic Peroxides
    * Toxic (Poisonous) and Infectious Substances
    * Radioactive Material
    * Corrosives

* Articles of Extraordinary Value or Valuable Cargo such as

    * Airline ticket stock
    * Archaeological artifacts
    * Artwork
    * Articles of antiquity and antiques
    * Bank cards and/or credit cards

    * Hazardous waste, including, but not limited to, used hypodermic needles or syringes, or other medical waste
    * Packages that are wet, leaking or emit an odor of any kind
    * Liquids such as but not limited to cooking oil, detergent, etc.
    * Shipments or commodities that are prohibited by any law, statute or regulation
    * Shipments that require us to obtain a local, state, provincial or federal license for their transportation
    * Shipments that may cause damage or delay to equipment, personnel or other shipments
    * Wooden crates

LBC is not liable for delay of, loss of or damage to a shipment of any prohibited item. The shipper agrees to indemnify LBC for any and all costs, fees and expenses LBC incurs as a result of the shipper’s violation of any local, state or federal laws or regulations or from tendering any prohibited item for shipment.
